Terms of Service

These terms are maintained by Gajendra Training Technologies LLP (operating as TRAFIXEL) and cover use of trafixel.com and the general basis on which we work with clients. They are general terms, not legal advice; a signed proposal or agreement takes precedence where the two differ.

1. Using this website

Content on this site is provided for information only. Benchmarks, ranges and results shown in case studies reflect specific past engagements and are not a promise of similar outcomes. You agree not to misuse the site, attempt unauthorised access, or scrape it in a way that degrades service for others.

2. Enquiries and proposals

Submitting a form or booking a call creates no obligation on either side. Pricing shown on the site is indicative; the binding scope, fee and timeline are those in the written proposal or statement of work you accept.

3. Scope and deliverables

Each engagement defines its own deliverables, cadence and reporting. Work outside that scope is quoted separately before it begins. Timelines assume timely client input — approvals, assets, platform access and stakeholder availability.

4. Client responsibilities

You are responsible for providing accurate information, for the lawfulness of the products or claims you ask us to promote, for maintaining your own ad account billing, and for any consents required to contact people on lists you supply.

5. Fees and payment

Retainer fees are invoiced in advance of each service period unless the proposal states otherwise. Media spend is paid by you directly to the advertising platform and is separate from our fees. Taxes apply as required under Indian law. Persistent non-payment may lead to work being paused after written notice.

6. Third-party platforms

Our work depends on platforms we do not control — including Google, Meta, LinkedIn, WhatsApp, Shopify, email service providers and analytics tools. Policy changes, account restrictions, algorithm updates or outages on those platforms can affect results and are outside our control.

7. Intellectual property

On full payment for an engagement, you own the final deliverables produced specifically for you — creative assets, copy, landing pages and reports. We retain ownership of our pre-existing frameworks, templates, internal tooling and methodology, and may reuse generalised learnings in other work.

8. Confidentiality

Each side keeps the other's non-public information confidential and uses it only to perform the engagement. We may reference your brand and anonymised or approved results in our portfolio unless you ask us in writing not to.

9. Term and cancellation

Retainers run month to month after any stated minimum term and may be ended by either side with 30 days' written notice. Fees for the current period and work already performed remain payable. On exit we hand over accounts, assets and documentation we control.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising from an engagement is limited to the fees you paid us in the three months before the claim, and neither side is liable for indirect or consequential loss, including lost profits or lost revenue.

11. Governing law

These terms are governed by the laws of India, with courts at Samastipur, Bihar having jurisdiction, unless a signed agreement specifies otherwise.
